آليات استرجاع العائدات الإجرامية في جرائم الفساد

Abstract

شكل الأموال المنهوبة بفعل الفساد مشكلة خطيرة لضياع أموال الدولة، إذ أن من شأن هذه الخسائر النقدية استنزاف أموال الشعب وموارد التنمية. وإذا كانت الأموال المتواجدة داخل إقليم الدولة لا تطرح إشكاليات استرجاعها كونها تتم عن طريق الوسائل القانونية المتاحة لهذا الغرض كالمصادرة، فإن الاشكالية تطرح بالنسبة للأموال الموجودة في خارج إقليم الدولة وخصوصا في بعض الدول التي تعقد من استرجاع الأموال المتواجدة على أراضيها، مما يستلزم الكثير من الإجراءات المعقدة والطويلة بغية استرجاعها وفق الكيفيات والأليات المقررة في اتفاقية الأمم المتحدة لمكافحة الفساد. وعليه فما هي هذه الأليات العملية الكفيلة باسترجاع هذه الأموال في ظل الاتفاقية، وهل تعتبر هذه الوسائل كافية لوحدها لعمل المطلوب أم لابد أن تدعم بآليات أخرى عملية بغية الوصول إلى نتائج عملية. Abstracts The looted funds due to corruption constitute a serious problem for the loss of state funds, as these monetary losses would drain the people's money and development resources. And if the funds located within the territory of the state do not pose problems of recovering them, as they are done through the legal means available for this purpose, such as confiscation, then the problem arises with regard to the funds located outside the territory of the state, especially in some countries that complicate the recovery of funds located on their lands, which requires a lot of complex and long procedures in order to recover them according to the modalities and mechanisms established in the United Nations Convention against Corruption. Accordingly, what are these practical mechanisms that guarantee the recovery of these funds under the agreement, and are these means sufficient on their own to do what is required, or must they be supported by other practical mechanisms in order to reach practical results?
