Abstract

تبحث هذه المذكرة في موضوع إدماج الذكاء الاصطناعي داخل الشركات التجارية، كشريك في التكوين أو التسيير وما يطرحه ذلك من تحديات قانونية وأخلاقية، وقد حاولت الدراسة استكشاف مدى قدرة القواعد التقليدية على مواكبة هذا التحول في ظل تطور الذكاء الاصطناعي كفاعل اقتصادي مؤثر. كما اقترحت تصورا قانونيا أوليا يسهم في تأطير هذه الوضعية مع الدعوة إلى تطوير تشريعات تواكب التحول الرقمي وتضمن أمن المعاملات واستقرار البيئة الاقتصادية. الكلمات المفتاحية:الذكاء الاصطناعي، الشريك الذكي، الشركات التجارية، التحديات القانونية. Abstract This thesis explores the integration of artificial intelligence into commercial companies as a partner in formation or management, and the legal challenges this raises, the study seeks to assess the extent to which traditional legal frameworks can adapt to this emerging reality, given the evolution of AI as an influential economic actor. It also proposes a preliminary legal model aimed at regulating this status, while calling for the development of legislative frameworks that align with digital transformation and ensure transactional security and economic stability.
