الحماية القانونية للعقار الفلاحي في الجزائر

Abstract

تهدف هذه الدراسة إلى الحماية القانونية للعقار الفلاحي في التشريع الجزائري، فكان لابد من الوقوف على ماهية العقار الفلاحي وأصنافه، وكذا التعرف على ضبط وتسيير العقار الفلاحي من خلال إلزامية إستغلاله والمحافظة على طابعه الفلاحي. كما تهدف هذه الدراسة إلى إبراز وتوضيح أهم الآليات والوسائل القانونية لحماية الأراضي الفلاحية المتمثلة في الحماية المدنية، الحماية الجزائية والحماية الإدارية. الكلمات المفتاحية: العقار الفلاحي، تسيير العقار الفلاحي، الحماية المدنية، الحماية الجزائية، الحماية الإدارية، الآليات القانونية.

Abstract This studyaims to protect the legalproperty of agricultural land in Algerian legislation, itwasnecessary to identify the nature of agricultural real estate and itsvarieties, as well as to identify the control and management of agricultural real estatethrough the obligation to exploit it and maintainits agricultural character. This studyalsoaims to highlight and clarify the most important legalmechanisms and means for the protection of agricultural lands, represented in civil protection, penal protection and administrative protection.
