التزامات التاجر المهنية في التشريع الجزائري

Abstract

يعد الإلتزامات المهنية للتاجر، من بين الإلتزامات التي ألقاها المشرع الجزائري على عاتق التاجر، و التي هي مسك الدفاتر التجارية، و القيد في السجل التجاري، ولذلك لما تحمله من أهمية كبيرة. وفي مجال المعاملات التجارية ، حيث ترتب هذه الإلتزامات حقوقا، التي تتمثل في اكتساب صفة التاجر، وهذا بالنسبة للشخص الطبيعي. كما يكتسب الشخص المعنوي، هذه صفة التجارية التي يصبح يزاول مهامه بطريقة قانونية وله الحجية في الدفاع عن نفسه أمام القضاء. و إذا خالف القانون و التنظيم المعمول به، يورط نفسه، حيث يتحمل تبيعة أثار تجرة إلى الجزاءات المدنية و الجزائية ونزع الصفة التجارية. Résumé: The professional obligations of the trader are among the obligations imposed by the Algerian legislator on the trader, whichis the keeping of commercial books, and registration in the commercial register, and thereforebecause of the great importance itbears. In the field of commercial transactions, these obligations entailrights, which are represented in acquiring the status of a merchant, and thisis for a naturalperson. As the legalpersonacquiresthis commercial capacity, hebecomeslegallyengaged in hisduties and has the right to defendhimselfbefore the courts. And if heviolates the applicable law and regulation, hewillimplicatehimself, as hebears the consequences of his sale to civil and penal penalties and the removal of commercial character.
