النظام القانوني لشهادة المطابقة

Abstract

تعد التهيئة العمرانية ركيزة أساسية من ركائز التنمية المستدامة, وتلعب الآليات القانونية دورا محوريا في تنظيم ممارسات البناء, ومن بين هذه الآليات تعتبر شهادة المطابقة وثيقة إدارية حاسمة تؤكد امتثال البناء لما هو منصوص عليه في رخصة البناء. تتناول هذه الدراسة الاطار القانوني الذي يحكم شهادة المطابقة في الجزائر, مركزة على القانون رقم 08-15, والقانون رقم 90-29, وتعتمد الدراسة على المنهج الوصفي التحليلي, وتسلط الضوء على التحديات العملية في التطبيق, مقترحة إصلاحات لتحسين وضوح النصوص القانونية, وتنسيق العمل الإداري ورفع الوعي العام. الكلمات المفتاحية: شهادة المطابقة - رخصة البناء –تصريح بانتهاء الأشغال – رئيس المجلس الشعبي البلدي. Abstract: Urban planning is a key pillar of sustainable development, and legal mechanisms play a central role in regulating construction practices. Among these, the Certificate of Conformity is a crucial administrative document confirming that a building complies with it’s the construction permit. This paper examines the legal framework governing this certificate in Algeria, focusing on law no. 08-15m law no. 90-29, the study employs a descriptive-analytical approach and highlights the practical challenges in implementation, proposing reforms to improve legal clarity, administrative coordination, and public awareness.
