Abstract

تتمحور الدراسة حول موضوع الامتيازات الإجرائية والإدارية الممنوحة للمستثمر، التي يتعين الحصول على معظمها توفر شرطين يتمثل الأول في قيام المستثمر الذي يرغب في الاستفادة من مزايا قانون الاستثمار بطلب تسجيل استثماره لدى الوكالة الوطنية لترقية الاستثمار إما حضوريا أو الكترونيا عن طريق المنصة الرقمية للمستثمر ، الثاني في حصول المستثمر على شهادة الاستثمار من طرف مدير الشباك المختص وذلك بعد دراسة طلب المستثمر والتي تسمح له بالحصول على حقوقسواء أمام الوكالة الوطنية لترقية الاستثمار أو أمام الهيئات الإدارية المرتبطة بالاستثمار. ومن صور الامتيازات الإجرائية الممنوحة للمستثمر في قانون الاستثمار الجزائري امتياز الاعفاء عن إجراء التوطين البنكي وإجراءات التجارة الخارجية، وتكريس إجراء الطعن أمام اللجنة الوطنية العليا للطعون المتعلقة بالاستثمار، ومن صور الامتيازات الإدارية تكريس المشرع الجزائري جهاز مؤسساتي استثماري يتمثل في الوكالة الوطنية لترقية الاستثمار التي تعتبر كامتياز اداري للمستثمر من خلال ما تقدمه من خدمات، والمجلس الوطني للاستثمار باعتباره كهيئة استثمارية عليا وكمجلس حكومة مصغر يعمل على اقتراح استراتيجية الاستثمار وتنفيذها والتنسيق بين الهيئات المتعلقة بالاستثمار سواء داخل أو خارج الوطن والذي يعتبر بدوره كامتياز إداري مسبق ممنوح للمستثمر، بالإضافة إلى الامتيازات التي تقدمها إدارات ومصالح وهيئات أخرى مرتبطة بالاستثمار من تبسيط وتنفيذ الإجراءات المتعلقة بالاستثمار بمنح التراخيص، والوثائق، وتوفير الجو الملائمومرافقة المستثمر بالإضافة إلى ما تمنحه من امتيازات في مجالات أخرى كمجال الضرائب والجمارك وغيرها. الكلمات المفتاحية: الامتيازات الحوافز ، امتيازات المستثمر، الامتيازات الإدارية الامتيازات الإجرائية. Abstract The study revolves around the procedural and administrative advantages granted to investors. To obtain most of these advantages, two main conditions must be met. First, the investor must apply to register their investment with the National Agency for Investment Promotion, either in person or electronically via the digital investor platform. Second, the investor must obtain an investment certificate from the competent one-stop shop manager after their application has been reviewed. This certificate grants the investor rights before the National Agency for Investment Promotion and other relevant administrative bodies. Among the procedural advantages granted to investors under Algerian Investment Law are exemptions from banking localization requirements and foreign trade procedures. The law also establishes the right to appeal to the High National Committee for Investment Appeals. On the administrative side, the Algerian legislator has established an institutional framework that includes the National Agency for Investment Promotion, which offers administrative advantages through its services, and the National Investment Council, which acts as a high-level investment authority and a mini-government council, This council proposes and implements investment strategies and coordinates between investment-related bodies both domestically and internationally, constituting an administrative advantage for the investor. Additionally, various other administrative departments, services, and bodies related to investment offer simplifications and facilitation of investment procedures, such as granting licenses, providing necessary documents, creating a favorable environment, and supporting the investor, along with other advantages in areas like taxation and customs.
