Item حماية الساحل في التشريع الجزائري(مكتبة كلية الحقوق و العلوم السياسية جامعة محمد البشير الابراهيمي برج بوعريريج, 2026-01-13) اسحاق سعادة; الحواس خلفونيشكل الساحل جزءا فريدا ومتميزا من الإقليم الوطني لما يزخر به من إمكانيات هائلة للتنمية الاقتصادية ، السياحية و البيئية تمارس عليه إكراهات عديدة أبرزها الضغط الديموغرافي ،الصناعة و التعمير العشوائي مما يجعله محلا للتدهور واستنزاف موارده الطبيعية. لهذا كرس المشرع الجزائري حماية قانونية للساحل من خلال سن تشريع خاص به تمثل في إصدار القانون 02/02 الذي أسس لجملة من الوسائل القانونية،الإدارية ،المؤسساتية و المالية بهدف حماية ، تثمين و استدامة المنطقة الساحلية ودمجها في نطاق السياسة الوطنية لتهيئة الإقليم و تنميته المستدامة .إلا أن انعدام التنسيق المتكامل بين مختلف الفاعلين في السياسة الوطنية لتهيئة وحماية الساحل و نقص التطبيق الصارم للتدابير الحمائية على الوجه المطلوب أضعف من فعالية هذه الحماية على أرض الواقع. الكلمات المفتاحية الساحل ، الحماية القانونية، التثمين ،استدامة الساحل Summary: The coastline represents a unique and distinctive part of the national territory due to its immense potential for economic, tourism, and environmental development. However, it faces numerous pressures, most notably demographic pressure, industrial activities, and uncontrolled urbanization, which contribute to its degradation and the depletion of its natural resources. For this reason, the Algerian legislator has established legal protection for the coastline through the enactment of a specific law, Law 02/02. This law laid the foundation for a set of legal, administrative, institutional, and financial mechanisms aimed at protecting, enhancing, and ensuring the sustainability of the coastal area, and integrating it into the national policy for regional planning and sustainable development. However, the lack of integrated coordination among the various stakeholders in the national policy for coastal planning and protection, as well as the insufficient enforcement of protective measures, has weakened the effectiveness of this protection on the ground.
