الاوامر القضائية لقاضي التحقيق

Abstract

يعتبر المشرع الجزائري قاضي التحقيق هيئة قضائية حول لها صلاحيات واسعة في إطار التحقيق الانتفاعي، فهي علامة الدرجة الأولى كجهة التحقيق في المواد الغزالية. ققاضي التحقيق بشكل جهارا قضائيا قالما بذاته أو وظيفتين الأولى تتمثل في البحث من الأدلة المتعلقة بالان كونه يلعب دور الحكم الذي يبحث عن الحقيقة. فأوامر قاضي التحقيق رغم خطورتها المساس البعض منها تجربات وحقوق الأفراد، في إجراءات كرستها النصوص القانونية والإجرائية يصدرها وفق السلطة التقديرية الغاية منها إظهار الحقيقة. الكلمات المفتاحية:قاضي التحقيق، غرفة الاتهام، الإستئناف، النيابةالعامة، الحبس المؤقت، قانون الاجراءات الجزائية

Abstract: The Algerian legislator considers the investigating judge a judicial authority vested with broad powers within the framework of investigative proceedings. The investigating judge is regarded as a primary authority in criminal investigation matters. He functions as both a judicial body and a dual-role figure: first, by searching for evidence related to the case; and second, by acting as a neutral arbiter seeking the truth. Although the investigating judge’s orders can significantly impact individual freedoms and rights, they are issued based on legal and procedural texts and are guided by discretionary power aimed at uncovering the truth.
