ABSTRACT : In this memorandum, we addressed the conditions and procedures for establishing commercial banks in Algerian law in light of the new amendments. We started from the problematic aspect of how the Algerian legislator has organized the provisions pertaining to the establishment or incorporation of banks in the new law. We reached important conclusions, including the removal of the 10-month period from the date of notification of the rejection of the first request to submit a second request. The preservation of a direct appeal before the appellate body, which affects the guarantee, and two-stage litigation. The Algerian legislator addressed the deadlines for filing a lawsuit in the event of a refusal to block the licensing decision by the Monetary and Banking Council, while neglecting the extremism of the notification deadlines.
