مكانة التفويض التشريعي في جرائم الأعمال

Abstract

لقد تناولت في هذه المذكرة موضوع مكانة التفويض التشريعي في جرائم الأعمال. إذ يعتبر التفويض التشريعي في مجال الأعمال من الآليات القانونية المعاصرة التي فرضها تطور البيئة الاقتصادية وتعقيد الأنشطة التجارية. حيث خلصت الدراسة إلى أن جرائم الأعمال تعد جرائم ذات طبيعة خاصة ترتكب في الغالب من طرف فاعلين اقتصاديين باستعمال وسائل قانونية ظاهرية لتحقيق أهداف غير مشروعة ، كما بينت أيضا أن آلية التفويض التشريعي رغم فعاليتها النسبية تثير إشكاليات دستورية تتعلق بمبدأ الشرعية الجنائية وفصل السلطات . وعليه توصي الدراسة بضرورة تقنين شروط وحدود هذا التفويض بشكل أكثر دقة ، ووضع تعريف قانوني واضح لجرائم الأعمال . Abstract: This dissertation examined the topic of the status of legislative delegation in business crimes. Legislative delegation in the field of business is considered one of the modern legal mechanisms imposed by the evolution of the economic environment and the complexity of commercial activities. The study concluded that business crimes are of a special nature, often committed by economic actors using apparent legal means to achieve unlawful objectives. It also demonstrated that, despite its relative effectiveness, the mechanism of legislative delegation raises constitutional issues related to the principle of criminal legality and the separation of powers. Accordingly, the study recommends the need to precisely regulate the conditions and limits of such delegation, and to establish a clear legal definition of business crimes.
