الأحكام الإجرائية و الموضوعية لجريمة المضاربة في القانون الجزائري

Abstract

خلال أزمة كوفيد - 19 ، شهدت الجزائر انتشارا واسعا للتكهنات غير المشروعة، حيث استغل المتكهنون الأزمة لتحقيق أرباح كبيرة على حساب المواطنين. دفع هذا الأمر السلطات الجزائرية إلى التدخل من خلال إصدار تشريعات صارمة ورادعة، وهي قانون رقم 21-15 المتعلق بمكافحة المضاربة غير المشروعة، بهدف مواجهة جميع أشكال التكهن التي تسعى لخلق نقص أو اضطراب في السوق. تشمل هذه القانون مجموعة من الآليات التي تركز على منع جميع أشكال المضاربة غير المشروعة تشمل هذه الآليات تدابير وقائية لتعزيز تدخل الدولة أو الحكومات المحلية، وتنشيط دور المجتمع المدني ووسائل الإعلام، بالإضافة إلى الآليات الإجرائية. يتضمن القانون أيضا مجموعة من التدابير العقابية، بما في ذلك عقوبات أكثر صرامة من تلك المنصوص عليها في القانون الجنائي، سواء كانت عقوبات أساسية أو تكميلية، والتي تطبق على الأشخاص الطبيعيين والمعنويين. Summary: During the COVID-19 crisis, Algeria witnessed a widespread proliferation of illegal speculation, as speculators exploited the crisis to make substantial profits at the expense of citizens. This compelled Algerian authorities to intervene by enacting strict and deterrent legislation, namely Law No. 15-21 concerning the combat against illegal speculation, aimed at tackling all forms of speculation seeking to create shortages or disruptions in the market. This law includes a range of mechanisms focusing on preventing allforms of illegal speculation. These mechanisms encompass preventivemeasures to enhance state or local government intervention, activate therole of civil society and the media, in addition to procedural mechanisms. The law also incorporates a set of punitive measures, including penaltiesmore severe than those stipulated in criminal law, whether primary orsupplementary penalties, applicable to both natural and legal persons.
