قرار الهدم بين نظام الرخصة و الجزاء الاداري في التشريع الجزائري

Abstract

يُعدّ قرار الهدم في التشريع الجزائري أداة قانونية لضبط المخالفات العمرانية، خاصة في ظل الانتشار الواسع للبناء غير المرخّص. يرتبط هذا القرار بنظام الرخص، إذ يُشترط الحصول على رخصة البناء، وأي خرق لذلك يستوجب التدخل الإداري. كجزاء إداري، يُنفذ قرار الهدم دون الحاجة إلى حكم قضائي، ما يمنح الإدارة مرونة وسرعة في التصدي للمخالفات. غير أن الواقع المعاش يكشف عن تحديات عديدة، أبرزها ضعف الرقابة الميدانية، والضغوط الاجتماعية والسياسية التي تعرقل تنفيذ قرارات الهدم. كما تُطرح إشكالات تتعلق بحماية حقوق الأفراد وحقهم في الطعن، في ظل غياب الشفافية أحيانًا. لذلك يبقى تحقيق التوازن بين سلطة الإدارة واحترام الضمانات القانونية ضرورة ملحّة لضمان عدالة عمرانية فعالة. الكلمات المفتاحية: قرار الهدم، النظام العام العمراني، رخصة الهدم، حق الملكية. ABSTRACT: Under Algerian law, the demolition order is a legal tool for controlling urban violations, especially in light of the widespread unlicensed construction. This order is linked to the licensing system, which requires a building permit, and any violation of this requirement requires administrative intervention. As an administrative sanction, the demolition order is implemented without the need for a court ruling, giving the administration flexibility and speed in addressing violations. However, the reality on the ground reveals numerous challenges, most notably weak field oversight and social and political pressures that hinder the implementation of demolition orders. Issues also arise related to the protection of individual rights and their right to appeal, given the occasional lack of transparency. Therefore, achieving a balance between administrative authority and respect for legal guarantees remains an urgent necessity to ensure effective urban justice.
