ضمانات المشتري الإلكتروني في التشريع الجزائري

Abstract

إن التطور التكنولوجي لوسائل الاتصال أثر تأثيرا كبيرا على النظام القانوني للعقود التقليدية مما أدى الي ظهور أنماط حديثة من بينها العقود الإلكترونية التي تتم عبر شبكة الانترنت، والتي تثير العديد من الإشكالات القانونية حول انعقاد هذا العقد الالكتروني وخاصة ما يتعلق منها بضمانات المشتري الالكتروني، وذلك لما يتميز به من اختلال في التوازن العقدي بين المورد والمشتري . الأمر الذي دفع بالمشرع الجزائري إلى تشريع اطار قانوني يوفر الحماية للمشتري الالكتروني قبل وأثناء ابرام العقد وأثناء التنفيذ بهدف حمايته باعتباره الطرف الضعيف في العلاقة التعاقدية ،وأول هذه القوانين التي اقرها المشرع الجزائريرقم 09-03 المتعلق بحماية المستهلك وقمع الغش ثم القانون رقم18-05 المتعلق بالتجارة الالكترونية . الكلمات المفتاحية: التجارة الالكترونية ، المستهلك الالكتروني ، الضمانات ، العقد الالكتروني ، حق العدول.

Summary : The technological development of means of communication has had a significant impact on the legal system of traditional contracts, which has led to the emergence of modern patterns, including electronic contracts that are conducted via the Internet, which raise many legal problems regarding the conclusion of this electronic contract, especially those related to electronic buyer guarantees, because It is characterized by a contractual imbalance between the supplier and the buyer. This prompted the Algerian legislator to legislate a legal framework that provides protection for the electronic buyer before and during the conclusion of the contract and during implementation, with the aim of protecting him as the weak party in the contractual relationship. The first of these laws approved by the Algerian legislator No. 09-03 related to consumer protection and the suppression of fraud.Then Law No. 18-05 related to electronic commerce.
