Abstract

Construction crimes in Algerian legislation are serious violations that affect the organization of construction and the safety of the environment. It is regulated by law, in particular Law No. 08-15 on conformity and Decree No. 15-19 regulating construction contracts, criminalizing any construction carried out without a permit or contrary to what is stipulated in the building or retail permit. These offenses include construction in restricted areas, exceeding the specified height or area, or using materials that violate technical standards. Perpetrators of these crimes are punished with fines, and sometimes with the forced demolition of the violating structure. The project owner, the contractor and the supervising engineer are also legally responsible. Through these provisions, the State shall seek to preserve the urban character and sustainable development. Penalties shall also apply to public officials in the event of their leniency or complicity. The authorities stress the importance of adhering to laws to ensure urban security.
