Abstract

تعتبر الملكية العقارية من الحقوق الممنوحة للمالك وله كامل الحرية في التصرف في هاته الملكية، غير أن المشرع الجزائري قيد هاته الحرية وذلك من خلال القوانين والمراسيم أهمها آخر تعديل وهو المرسوم التنفيذي رقم: 24/247 وهذا من أجل الموازنة بين المصلحة العامة والخاصة. حيث جعل عملية البناء تخضع وجوبا إلى الحصول على رخصة البناء التي تعتبر من الأدوات الضرورية لحماية ووقاية المجتمع من الأخطار التي قد تنجر عن ممارسة النشاط العمراني بصورة آمنة ومنتظمة، وهاذا للحد من التجاوزات في حركة البناء والتعمير جملة من القيود على عملية البناء. فأي عملية بناء يجب أن تخضع لمجموعة من المقاييس والقواعد التقنية المحددة والمضبوطة قانونا للنهوض قدما بالنشاط العمراني ومواكبته تكنولوجيا البناء الحديثة الكلمات المفتاحية :رخصة البناء، التشريع، رقمنة، الشباك الوحيد، مسكن فردي، سكن جماعي، الضبط الإداري

Abstract: Real estate ownership is considered a right granted to the owner, who has complete freedom to dispose of this property. However, the Algerian legislator has restricted this freedom through laws and decrees, the most important of which is the latest amendment, Executive Decree No. 24/247, in order to balance the public and private interests. The construction process is subject to obtaining a building permit, which is considered one of the necessary tools to protect and safeguard society from the dangers that may result from practicing urban activity in a safe and regular manner. This is to limit violations in the construction and building movement, and a set of restrictions on the construction process. Any construction process must be subject to a set of specific and legally regulated technical standards and rules to advance urban activity and keep pace with modern construction technology.
