منازعات شهادة المطابقة في التشريع الجزائري

Abstract

يمثل العمران البشري المرآة العاكسة التي تبين مدى تطور الدولة وازدهارها، وكذا رقيها الفكري والثقافي، ناهيك عن امتداد جذورها عبر التاريخ، ولعل البناءات والتشييدات أحد أهم هاته العلامات على ذلك. فالعمران هو أحد أهم القطاعات الحيوية التي سعت الدولة الجزائرية من خلال الترسانة القانونية عامة والقانون 08-15 المتعلق بمطابقة البنايات خاصة، والذي جاء بإحدى أهم الوسائل القانونية التي من شأنها تدارك النقائص وتصحيحها، سعيا منه إلى تحقيق النظام العام العمراني الجمالي. فشهادة المطابقة هي إحدى أهم الوسائل القانونية التي تهدف إلى تحسين وجه المدينة، وكذا تحقق في مدى إمكانية استعمال واستغلال المساكن من طرف ملاكها وفق التشريع المعمول به. إلا أن هاته الشهادة قد ينجر عنها عديد المنازعات في ساحات القضاء العادي والإداري، والتي تعكر صفو بلوغ أهدافها المرجوة في إطار تحقيق التنمية المستدامة. الكلمات المفتاحية: شهادة المطابقة، النظام العام العمراني، التنمية المستدامة ، منازعات شهادة المطابقة.

ABSTRACT: Human settlement represents a mirror reflecting the extent of a country's development and prosperity, as well as its intellectual and cultural advancement, not to mention its historical roots. Perhaps one of the most important indicators of this is buildings and construction. Urban development is one of the most vital sectors that the Algerian state has sought to address through its legal framework in general, and Law 08-15 on Building Conformity in particular. This law provides one of the most important legal tools to address and correct deficiencies, in an effort to achieve an aesthetic urban public order. The certificate of conformity is one of the most important legal tools aimed at improving the city's appearance and verifying the extent to which housing can be used and exploited by its owners in accordance with applicable legislation. However, this certificate may result in numerous disputes in ordinary and administrative courts, which hinder the achievement of its desired goals within the framework of achieving sustainable development.
