الحماية الجزائية للتراث الثقافي في ظل القانون04/98 المعدل و المتمم

Abstract

يولي المشرع الجزائري أهمية كبيرة لحماية التراث الثقافي، لما له من قيمة رمزية وتاريخية تمثل هوية الأمة واستمراريتها، وقد كرس القانون رقم 98-04 المتعلق بحماية التراث الثقافي، المعدل والمتمم، مجموعة من الأحكام الزجرية التي تهدف إلى ردع الأفعال الماسة بالممتلكات الثقافية، سواء من خلال التخريب، التهريب، الإتجار غير المشروع أو الإهمال، وقد أقر المشرع عقوبات جزائية متنوعة تتناسب مع جسامة الأفعال المرتكبة، كما أسند للسلطات المختصة، لا سيما أجهزة الضبط القضائي وإدارة الجمارك، دورا محوريا في التصدي لهذه الجرائم، مما يعكس الإرادة الوطنية في تعزيز حماية التراث الثقافي وفق مقاربة قانونية صارمة وفعّالة. الكلمات المفتاحية: التراث الثقافي، الحماية الجزائية، القانون 98-04، التجريم، التهريب، الممتلكات الثقافية. Abstract: The Algerian legislator places great importance on the protection of cultural heritage, given its symbolic and historical value as a representation of the nation's identity and continuity. Law No. 98-04 on the protection of cultural heritage, as amended and supplemented, establishes a set of punitive provisions aimed at deterring acts that harm cultural property, whether through vandalism, smuggling, illicit trafficking, or negligence. The law provides for various criminal penalties proportional to the severity of the offenses committed and assigns a central role to the competent authorities—particularly judicial police services and customs administration—in combating these crimes. This reflects the national will to enhance the protection of cultural heritage through a strict and effective legal approach.
