القانون الواجب التطبيق على الإلتزامات التعاقدية

Abstract

يعتبر ضابط الإرادة الضابط الأصلي في تحديد القانون الواجب التطبيق على موضوع الالتزامات التعاقدية في العلاقات ذات العنصر الأجنبي بشرطوجود صلة حقيقية بين القانون المختاروالمتعاقدينأو بالعقد. وبغيابه، يُلجأ إلى قانون الموطن المشترك أو الجنسية المشتركة للمتعاقدين كضابطين احتياطيين، وإذا تعذر ذلك يتم تطبيق قانون مكان إبرام العقد، مع استثناء العقود المتعلقة بالعقار الخاضعة لقانون موقعها. أما من حيث الشكل، فتخضع الالتزامات التعاقدية لقانون محل الإبرام، أو للقانون الموطن المشترك، أو الجنسية المشتركة، أو للقانون المطبق على جوهر العقد. وقد كرس المشرع الجزائري هذه الضوابط في المادتين 18 و19من القانون المدني. الكلمات المفتاحية:تنازع القوانين/ الالتزامات التعاقدية/قانون الإرادة/ الجنسية المشتركة / الموطن المشترك/ محل الإبرام/ القانون الواجب التطبيق. Summary: The principle of party autonomyis the primarycriterion in determining the applicable law for contractual obligations in international relationships, providedthatthereis a genuineconnectionbetween the chosenlaw and the contracting parties or the contractitself. In the absence of such a choice, the law of the common domicile or commonnationality of the contracting parties serves as a secondarycriterion. If thatis not possible, the law of the place where the contractwasconcludedisapplied, with the exception of real estatecontracts, which are subject to the law of the location of the property. As for the form of the contract, contractual obligations are subject to the law of the place of conclusion, the commonlaw of the parties, theircommonnationality, or the lawgoverning the substance of the contract. The Algerian legislator has enshrinedtheseprinciples in Articles 18 and 19 of the Civil Code.
