شهادة التعمير ودورها في حماية النظام العمراني في الجزائر

Abstract

تناولنا في هذه الدراسة المفهوم العام و القانوني لشهادة التعمير و أهم ما جاءت به القوانين و التنظيمات و المراسيم التنفيذية التي أشارت إلى شهادة التعمير و أعطت الأهمية القانونية لهذه الشهادة بحيث اعتبرت من أهم الوثائق القانونية و الإدارية المنظمة لعمليات البناء و التعمير في الجزائر كما أنها تساهم و تركز على دورها في حماية النظام العمراني بحماية المجال البيئي و حماية الأراضي الغير قابلة للتعمير و المجال العمراني من خلال ضمان التوازن بين التنمية العمرانية و احترام المخططات التنظيمية و التوجيهية. الكلمات المفتاحية: أدوات التعمير التنظيمية، النظام العمراني؛ شهادة التعمير؛ الأدوات الفردية وثيقة إدارية.

Abstract : In this study ;we addressed the general and legal concept of the certificate and the main issues discussed by laws ,regulation ;and executive decrees that referred to the certificate and granted it legal significance ,this certificate is considered one of the most important legal and administrative documents governing construction and urbanization processes in Algeria , it also contributes to protecting the system of urban planning and focuses on its role in safeguarding the urban environment , protecting unbuildable lands ,and the urban domain ,by ensuring a balance between urban development and adherence to regulatory and directive plans Keywords :Urban planning tools, certificate of urbanism ,executive tools, legal and administrative document
