Abstract

عقد المقاولة هو اتفاق خاص بين متعاقدين وهما المقاول ورب العمل، وكل له حق وعليه التزام ويختلف الاتفاق والدور حسب نوع المقاولة، يقوم العقد على البنود المتفق عليها ضمنه بهدف إنجاز محلها المطلوب، وتنقضي بأحكام الانقضاء الخاصة بها التي نظمها المشرع الجزائري، وإن لم تحدد أو لم يتم الاتفاق عليها من طرف المتعاقدين يتم اللجوء إلى الأحكام العامة لذلك. الكلمات المفتاحية: عقد المقاولة، المشرع الجزائري، رب العمل، المقاول.
